About the Credit:

  • Credit is 15% of the increase in Indiana QRE’s paid or incurred over the base amount up to $1 million.
  • The credit is 10% of any excess of QRE’s over $1 million.
  • For tax years after 2009, the the Alternative Simplified Credit Method is allowed. The credit is 10% of the excess of the current year’s QRE’s that is in excess of 50% of the average of the previous years’ QRE’s. If the taxpayer does not have 3 prior years of QRE’s then the credit is 5%.

Chemical Manufacturing Group Asks Senate for Permanent R&D Credit

A specialty chemicals group publicly applauded the House last week for passing the American Research and Competitiveness Act, and are now calling on the Senate to take the same action.

The Society of Chemical Manufacturers and Affiliates (SOCMA) is one of many associations backing The American Research and Competitiveness Act which would make the Research and Development Tax Credit permanent and raise the credit rate.

SOCMA says about one-fifth of their members’ workforce is involved in R&D and one-tenth of the companies are dedicated to research.

“By nature, specialty chemical manufacturing is innovative, and many SOCMA members rely on the R&D tax credit to help them remain competitive in the global marketplace,” said William Allmond, SOCMA’s senior lobbyist, according to Chem.Info.

The American Research and Competitiveness Act passed the House with a total vote of 274-145 which included 37 yes’ from Democrats. SOCMA and other supporters are worried that the bill won’t have the same outcome once it hits the Senate floor, or the President’s desk, if it even makes it there.

“If we’re going to get away from deficit spending, you’ve got to pay for things,” said Representative Xavier Becerra (D-CA). “Don’t act like you can do these things for free.”

Last year, two attempts to make the R&D credit permanent were shot down once they reached the Senate. SOCMA, along with many companies whose business relies on R&D are pleading for a different outcome this year.

Credit Carry Forward:Unused credits can be carried forward 10 years. There is no carry back.

About the Credit: The credit rate is 10%, but can not exceed 50% of the tax liability.  Tax years after 2009, the base amount is calculated using Georgia Gross Receipts. Prior to 2009, Georgia Taxable Income was used to compute the base.

Notes: To qualify for the Georgia state research tax credit, the taxpayer must have claimed and received a federal research tax credit for that specific tax year.

Florida

State Credit Name: Research and Development Tax Credit

Expiration Date: Indefinite

Who Can Apply? Only corporations that are engaged in one of the target industries identified by the Department of Economic Opportunity in Florida and have claimed and received a federal research tax credit.

Credit Carry Forward: Credits that exceed 50% of the income tax liability, the excess can be carried forward for up to 5 years. No carry back.

About the Credit: Beginning in tax year 2012, 10% of current year Florida QRE’s that exceed the average of the prior 4 years. The credit is applied against the Florida corporate income tax liability, but it cannot exceed 50% of the tax due after all other credits and liabilities have been applied.

Notes: Florida’s budget allocates $9 million per year for R&D credits. For business filing in 2016 for R&D expenses incurred in tax year 2015, the credit cap will be $23 million. After 2016, the credit cap will return to $9 million. If total credits for all applicants exceed the maximum allowed, credits are awarded on a prorated basis. The application must be filed on or after March 20th and before March 27th of the filing year.

R&D Tax Credit Vital to U.S. Jobs

Despite how crucial the Research and Development Tax Credit is to the U.S. economy, it has stayed a temporary credit since its creation in 1981.

But after 34 years of an off-and-on relationship, American businesses are ready for Congress to stop playing hard to get and commit to the R&D credit, and who’s to blame them.

The R&D credit not only promotes innovation and R&D within the U.S., but it serves as  a jobs credit as well. 70 percent of credit dollars are used to pay the salaries of R&D workers in the U.S.

There are R&D jobs to develop new products and services and there are countless divisions of jobs that work behind closed doors to bring those products and services to the consumers. The cycle continues when researchers create new products and services or invent new ways to enhance the value of the original innovation.

The temporariness of the tax code creates uncertainty for U.S. companies conducting larger R&D projects that will more than likely last longer than a year. If companies are not certain they will receive the credit over the expected life of the R&D project, they are less likely to spend the extra money on the research budget. This uncertainty is repressing R&D within the country by causing companies to spend less money on innovation than they would if the credit were permanent.

A permanent credit would assist in keeping good jobs with substantial pay here in America. There is a large global competition for R&D jobs and investment in research activities, giving companies a variety of choices on where to invest their research money. Other countries are beginning to offer more considerate R&D incentives than the U.S., which is leading American companies to take their research dollars and job opportunities overseas.

In the past year, there has been a lot of push for a permanent, more modernized and simplified credit. America is lagging behind other developing nations, and has reached its tipping point. Many members of Congress have realized this and have sponsored various bills, such as the COMPETE Act and the Domestic Research Enhancement Act of 2015,  that will have a positive effect on the R&D tax credit. The need for permanent, pro-innovation policies is now.

Colorado

State Credit Name: Research and Development Income Tax Credit for Enterprise Zones

Expiration Date: Permanent

Who Can Apply? Corporations and flow-through entities

Credit Carry Forward: Unlimited carry forward, but no carry back

About the Credit: The credit rate is 3% and the dollar limit that is imposed on the amount of expenses that can qualify is 25% of the amount of the credit. Taxpayers can claim the remaining 75% in 25% increments over the next 3 years. Unlike most state research credits, the qualifying research activities do not have to be performed within Colorado.

Notes: The Colorado research credit only adopts one of the requirements in the federal definition of qualified research activities, being that the expenses meet the definition of research and experimental expenditures. The credit does not require taxpayers to be able to currently deduct their R&E expenditures, which allows taxpayers to claim the credit for research activities that would not qualify for the federal research credit.

California and the R&D Tax Credit

State Credit Name: California Research Credit

Expiration Date: Permanent

Who Can Apply? Corporations and flow-through entities. S-Corps can only claim up to 1/3 against entity level tax, the rest may be passed through to shareholders and owners.

Credit Carry Forward: Unlimited carry forward, but no carry back.

About the Credit: The California Research Credit rate is 15% and it adopts the federal definition of qualified research activities and qualified research expenses. It is limited to research activities conducted in California.

Notes: The credit is calculated by comparing the taxpayer’s QRE’s to their gross receipts. The California Research Credit defines gross receipts as receipts from the sale of real, tangible, or intangible property held for sale to customers in the ordinary course of the taxpayer’s trade or business that is delivered or shipped to a purchaser in California. The difference between the taxpayer’s gross receipts and qualified research expenses can significantly maximize the credit.

State Credit Name: Research & Development Income Tax Credit

Expiration Date: Permanent

Who Can Apply? Corporations and Flow-Through Entities

Credit Carry Forward: 15 years, but with restrictions based on the tax year the credit was earned.

About the Credit: For 2011-2017, the credit is 24% of the first $2.5 million in excess QRE’s, 15% of excess QRE’s over $2.5 million. The base amount has to be calculated using the traditional method. For tax years 2018 and after, the credit will be 20% for the first $2.5 million in QRE’s and 11% for amounts that exceed $2.5 million.

Notes: The credit is partially refundable beginning in tax year 2011.  The taxpayer may elect to receive 75% of the excess credit refunded and waive the remaining 25% instead of carrying excess credit forward. To be eligible for the refund, the taxpayer must have less than 150 employees, receive a Certificate of Qualification from the Arizona Commerce Authority and have a current year Arizona R&D tax credit that exceeds its current year’s tax liability.

Spotlight on the R&D Tax Credit

After taking a long, hard look at America’s Research and Development Tax Credit, Congress realized that it was due for a much-needed makeover, and 2015 is the year to do it.

In February of 2015, the bipartisan COMPETE Act was introduced by Senators Tom Carper (R-DE) and Pat Toomey (R-PA) to drastically improve the R&D Tax Credit.

On May 20, 2015 the House passed the American Research and Competitiveness Act of 2015, which increases the R&D tax credit rate and makes the credit permanent.

That same day, the House received the most recently proposed improvement to the credit, the Domestic Research Enhancement Act of 2015, which modernizes the R&D Tax Credit to make certain contract research eligible.

Pharmaceutical, biotech and medical device companies can be heard cheering since contract research plays such a critical part in the development of new devices within these industries.

Another major supporter of the Domestic Research Enhancement Act of 2015 is the Association of Clinical Research Organizations (ACRO). ACRO represents companies that provide a range of specialized services that support the development of new pharmaceuticals, biologics and medical devices.

On May 21, 2015, Jamie Macdonald, the Chairman of ACRO and CEO of INC Research, issued the following statement in support of the Domestic Research Enhancement Act of 2015.

“ACRO commends Representatives Pat Meehan (R-PA), George Holding (R-NC) and G.K. Butterfield (D-NC) for co-sponsoring the Domestic Research Enhancement Act of 2015. This important piece of bipartisan legislation will help ensure that the United States remains a leader in medical innovation and encourages employment in the high-wage research sector. Pennsylvania and North Carolina remain the leading states for contract clinical research with more than 13,000 employees combined. By enabling contract research organizations to capture a portion of the R&D tax credit that is currently abandoned, this legislation will enable the United States to remain competitive globally. Similar provisions are included in the bi-partisan COMPETE Act introduced earlier this year by Senators Tom Carper and Pat Toomey. We look forward to enactment this year.”
